Buyers protection
This document outlines your rights and safeguards during your purchases on our platform. This document highlights crucial aspects related to your purchases, deliveries, rejections, returns, and the role of our Resolution Center.

1.Definitions

1.1 Buyer - A natural person or a company, registered on a Platform and agreed to these Conditions.

1.2 Seller - A natural person or a company, registered on a Platform and signed up for a Sellers Account. During registration, company agreed to these set of Terms & Conditions

1.3. Platform or Aumso - Aumso.com website and all services, offered by Ecom Europe Limited and other Service providers.

1.4 Parties - Buyer, Seller, the Platform

1.5. Purchase  - Purchasing agreement that is created between the Parties once order has been submitted and the amount according to the invoice is fully paid and cleared on the Platforms payment account.

1.6 Artwork - a unique product, existing in a single form, physical or digital, created by the seller and listed for sale on the platform.

1.7 the Delivery - signed and accepted parcel by anyone at the Buyers indicated address.

2.General conditions

2.1 This document describes the rights and obligations between Buyer and the Platform once the Purchase has been made.

2.2 Purchases or any agreements made outside the platform are not covered by the agreement.

2.3 Buyers Protection describes the way the Platform protects and enforces the Buyers rights in relation to fulfilling the Purchase agreements, made during the order.

3.Delivery

3.1 The Platform guarantees the Delivery of the purchased item to the Buyers address or email if it is a digital work.

3.2 The Platform does not guarantee or check authenticity of the item, however it gives unconditional Right to Reject and return the artwork within 2 days of receival.

3.3 If the Parcel is lost or damaged, the Platform guarantees a full  or partial refund, depending on the decision of the Resolution centre.

3. Right to reject

3.1 Buyer has the right to inspect and reject the artwork within 2 days of receiving the delivered artwork according to Delivery service.

3.2 This right is not applied when the Buyer chooses to pick up the goods.In such cases Buyer agrees that he inspected the artwork and agrees with its condition and authenticity.

3.3 This right is not applied when the Buyer chooses to to use storage service, provided by the Platform or Third party. If Buyer wishes to ensure authenticity of work, he can use our Authenticity check service. 

3.4 Delivery costs are reimbursed depending on the reason of the Reject

3.4.1 If the item is not authentic, full reimbursement of return delivery

3.42 If he doesn't like the artwork for any other reason, he is liable for returning the item to the Seller.

3.5 To use Right of Reject, the buyer has to open a Resolution dispute on the platform within 48 hours after the delivery is received.

4. Right to return

4.1 All artworks art not-returnable items, unless Right to reject is used.

4.1 Seller can optionally grant additional right to return the item within a period of time, indicated in the artwork description.

4.2 All additional shipping and handling conditions, stated in the description of the artwork are included in the Purchasing contract and can affect other Buyers rights and Resolution centre decisions.

4.3 All return expenses are covered by the Buyer or according to the agreement with the Seller via the Platform service “Sellers Chat”.

5. Resolution centre

5.1 Full Resolution Centre terms are described in a separate document published on the website and is part of the Terms & Conditions of use of the website, that Buyer agrees by using the website. If any of the above terms contradict the Resolution Center agreement, the preference will be given to the Resolution Centre agreement.

5.2 Resolution centre is a service provided by the Platform to  ensure Buyers Protection and a quick and reliable method for resolution of disputes between the Buyer and the Seller via an independent mediator, chosen by the Platform on a round robin principle and availability of the mediator.

5.3 The Platform acknowledges that it is not a party to the dispute resolution process facilitated by the Resolution Center. However, the Platform agrees to abide by any decision made by the Resolution Center without appeal, and will take the necessary actions to enforce the terms of the resolution as directed by the Resolution Center’s mediator.

5.4 All parties involved in the dispute resolution process facilitated by the Resolution Center are legally obligated to comply with the agreement reached through the mediation process. The decision made by the mediator, once agreed upon by the parties, shall be final and binding, and cannot be challenged or litigated in any court or tribunal

6. Digital Products and Rights

6.1 Full Digital Rights terms are described in a separate document published on the website and is part of the Terms & Conditions of use of the website, that Buyer agrees by using the website. If any of the above terms contradict the Digital Rights agreement terms, the preference will be given to the Digital Rights agreement.

6.2 The Platform guarantees the delivery of the digital artwork and copyright certificate to the buyer's email address via downloadable link within the term, submitted by the Buyer during the purchasing process.

6.3 The Platform guarantees the transfer of a smart contract to the Buyers wallet according to the conditions described in the artwork listing.

6.4 The Platform ensures the quality of a digital copy of the artwork, according to our Open Quality Standard. Buyer has the right to appeal the quality of the delivered digital work in the Resolution centre within 48 hours.
